Notification of Laws and Regulations of People’s Republic of China on Religious Belief and Rules and Disciplines of Hangzhou Normal University on Religious Belief

一、法律法规和校纪校规有关规定

I. Relevant Provisions of Laws and Regulations of the State and Rules and Regulations of the University

1.《中华人民共和国教育法》

1. Education Law of People’s Republic of China

第八条 教育活动必须符合国家和社会公共利益。国家实行教育与宗教相分离。任何组织和个人不得利用宗教进行妨碍国家教育制度的活动。

Article 8 Education activities shall conform to the public interests of the country and the society. In China, education is separated from religion. No organization or individual shall take advantage of religion to carry out activities that may interfere with the educational system of the country.

2.《中华人民共和国治安管理处罚法》

2. Law of P.R.C on Penalties for Administration of Public Security

第二十七条 有下列行为之一的，处十日以上十五日以下拘留，可以并处一千元以下罚款；情节较轻的，处五日以上十日以下拘留，可以并处五百元以下罚款：

Article 27 Personnel with any of the following behaviors shall be detained for a period of more than 10 days and less than 15 day and imposed a fine of less than RMB 1000 Yuan; minor violators will be detained for a period of more than 5 days and less than 10 days and imposed a fine of less than RMB 500 Yuan.

（一）组织、教唆、胁迫、诱骗、煽动他人从事邪教、会道门活动或者利用邪教、会道门、迷信活动，扰乱社会秩序、损害他人身体健康的；

(1) Organize, instigate, coerce, trick and instigate others to take activities of cults, superstitious sects and secret societies or take advantages of the activities of cults, superstitious sects and secret societies or superstition activities to disturb the social order or impair the others’ physical health.

（二）冒用宗教、气功名义进行扰乱社会秩序、损害他人身体健康活动的。

第五十五条 煽动、策划非法集会、游行、示威，不听劝阻的，处十日以上十五日以下拘留。

Article 55 Personnel who instigate and plan illegal assembles, parades, demonstrations and neglect dissuasion will be detained for a period of more than 10 days and less than 15 days.

3.《宗教事务条例》（中华人民共和国国务院令第426号）

3. Regulations on Religious Affairs (No.426 Decree of State Council of People’s Republic of China)

第四十条 信教公民的集体宗教活动，一般应当在宗教活动场所内举行，由宗教活动场所、宗教团体或者宗教院校组织。

Article 40 The collective religious activities of religious believers shall be generally carried out in specified religious venue and shall be organized by the religious venues, religious groups or religious academies.

第四十一条 非宗教团体、非宗教院校、非宗教活动场所、非指定的临时活动地点不得组织、举行宗教活动，不得接受宗教性的捐赠。

Article 41 Non-religious groups, non-religious academies, non-religious arena and non-designated temporary venues shall not carry out any religious activity or accept any religious donation.

4.《普通高等学校学生管理规定》（中华人民共和国教育部、中华人民共和国公安部第41号令）

4. Regulations on Management of Students in General Institutes of Higher Education (No.1 Decree of Ministry of Public Security of P.R.C and Ministry of Education of P.R.C)

第四十三条 学校应当坚持教育与宗教相分离原则。任何组织和个人不得在学校进行宗教活动。

Article 43 Schools shall stick to the principle of separating education from religious. No organization or individual shall carry out religious activities in campus.

5.《学校招收和培养国际学生管理办法》（中华人民共和国教育部、中华人民共和国外交部、公话人民共和国公安部第42号令）”

5. Administrative Measures of Schools in Enrollment and Education of International Students (No.42 Decree of Ministry of Education of P.R.C, Ministry of Foreign Affairs of P.R.C, and Ministry of Public Security of P.R.C)

第二十七条 国际学生经高等学校同意，可以在校内指定的地点和范围举行庆祝本国重要传统节日的活动，但不得有反对、攻击其他国家、民族的内容或违反公共道德的言行。

Article 26 International students may celebrate important traditional festivals of their own countries within the places and scopes designated by the universities upon unified arrangement of the schools. However, the activity shall not contain any contents that oppose or attack other countries or nations or any deed or word that violate public morality.

第二十九条 高等学校应当尊重国际学生的民族习惯和宗教信仰，但不提供宗教活动场所。学校内不得进行传教、宗教聚会等任何宗教活动。

Article 29 Institutions of higher education shall respect the national customs and religious belief of the international students but shall not provide venue for religious activities. No missionary work, religious assembly or any other religious activities shall be carried out within the campus.

6.《杭州师范大学学生违纪处分规定》（杭师大学〔2017〕89号）

6. Regulations of Hangzhou Normal University on Punishment of Discipline Violation (HSDX [2017] No.89)

第十四条 违反宪法，反对四项基本原则，组织、策划、实施煽动闹事，组织或参加非法集会、游行，加入邪教、非法宗教、非法社会组织或团体，非法传教，妨碍国家教育制度，破坏安定团结，扰乱社会秩序，危害国家安全者，视情节轻重和悔改态度，给予记过以上处分。

Article 14 Students who violate the constitution, oppose the Four Cardinal Principles, organize, plan and implement incitement or make troubles, organize or participate in illegal assembly or parade, join cults, illegal religions, illegal social organizations or groups, engage in illegal missionary work, hinder national education system, undermine stability and unity, disturb social order and endanger national security, shall at least have a record of demerit according to the seriousness of the case and attitude toward repentance..

第二十四条 （六）在学校内穿戴宗教服饰、进行宗教或迷信活动，经教育不改的，视情节轻重，给予警告以上处分；情节特别严重的，给予开除学籍处分。

Article 24 (6) Students who wear religious clothing, carry out religious or superstitious activities and do not repent after education shall at least be subjected to admonish according to the seriousness of the case; if the circumstance is particular serious, the student may be expulsed from academic status.

二、明确告知学生的有关事项

II. Matters to Be Explicitly Notified to Students

1. 应正确认识和对待宗教问题，提高识别、抵制和有效防范邪教的能力。

   1. Have a correct understanding and attitude of religious problems, and enhance the capacity of identifying, resisting and effectively guarding against cults.

2. 应尊重他人宗教信仰，不以宗教信仰、文化背景差异为理由在校内外引起任何冲突。

   2. Respect others’ religious beliefs and not arouse any conflict inside or outside the campus on the excuse of religious belief or the difference of cultural background.

3. 信教学生不得在校内从事任何形式的宗教活动，不能参加中国法律法规明确规定意外的场所进行的任何非法宗教活动。

   3. Students who believe religions shall not engage in any religious activities in the campus, shall not participate in any illegal religious activities in venues other than those explicitly stipulated by Chinese laws and regulations.

4. 学生在校内进行宗教活动的（包括聚众礼拜、非法传教等），给予警告至留校察看处分，为首或组织者，从重处分，情节严重者可考虑取消其学习签证，遣返回国；在校外进行非法宗教活动的，给予警告至留校察看处分，为首或组织者，从重处分，情节严重者可考虑取消其学习签证，遣返回国。

4. Students who carry out religious activities (including assembly for worshiping or illegal missionary work) shall be subjected to admonish and even probation. The leader or the organizer of the activities will be more severely punished or be canceled study visa and repatriated if the circumstance is serious; students who carry out illegal religious activities outside the campus shall be subjected to admonish and even probation. The leader or the organizer shall be more severely punished or be canceled study visa or be repatriated if the circumstance is serious.

本人已认真阅读，并知晓中华人民共和国有关宗教信仰方面的法律法规及杭州师范大学有关宗教信仰方面的校规校纪。
